Four Georgia employees of Louisville-based ResCare, Inc.—a home medical care provider that operates Southern Home Care Services, Inc. of Valdosta—have sued the company for failing to pay for their travel time to and from assignments. They say that’s a violation of the Fair Labor Standards Act.
The plaintiffs’ attorneys applied for class-action certification, which could affect thousands of current and former ResCare employees.
ResCare’s policy excludes pay for travel time between job sites. Plaintiffs’ attorney Kevin Hooks, of Kevin E. Hooks & Associates, LLC, in Savannah, said, “The law is clear that workers must be paid for travel when it’s an integral part of the job.”
The lawsuit seeks back wages for employees who have provided services to homebound clients since March 2004.
