A. Absolutely. Address it upfront for your own protection. Explain that the mere existence of such an agreement will not automatically prevent the applicant from consideration, but that you must review every such agreement for potential conflicts. If you don't request this information, you could face legal action from the former employer. For extra protection, make sure the applicant certifies this in writing.
