Scales tip against weight rule

The U.S. Supreme Court recently let stand a ruling that an airline's weight policy discriminated against women. (United Airlines v. Frank, 00-948)

The 9th U.S. Circuit Court of Appeals decided last year that United Airlines' former policy was illegal because the standards for women were based on medium body frames while the limits for men were based on large body types.

Although an employer may set different appearance standards for men and women, the court noted, United failed to justify the different weight standards as necessary for its business.
