A. We know of no law that would prohibit you from asking her to enter into such an agreement now, but be prepared to give her additional consideration in exchange for signing it. It's unclear under Ohio law whether continued employment alone is enough compensation, so offer a signing bonus to ensure your agreement will constitute a valid contract.
