The EEOC grip just got tighter: Newly upgraded strategy could trigger 'slew of cases'

Ouch for Employers! The Equal Employment Opportunity Commission’s Chair Naomi Earp stated at the 25th Annual Employment Law and Litigation Institute that EEOC attorneys now work as if they are part of a national law firm.

Instead of simply handling a complaint in the geographic region it was filed in, this new model allows EEOC attorneys to strategically scrutinize the employment practices of big companies with multiple sites nationwide and to effectively select the best venue to litigate in. The EEO’s Task Force on Systemic Discrimination is aggressively retooling to identify and stop workplace discrimination in the 21st century.

EEOC attorneys are focusing how new technology, such as video resumes and software that features the ability to identify applicants by protected traits, is being used to subtley discriminate. According to the Chair Earp, we can expect “a slew of cases” coming to the news in the next year.
