A woman who used to work for New York City’s Human Resources Administration has filed a multimillion-dollar lawsuit against a former supervisor she says drunkenly fondled her. The city agency and the union that represents agency employees are also named as defendants.

The woman, who was not identified in court papers, says Jose L. Cruz was visibly intoxicated when he stumbled into her cubicle one day, rubbed her back and shoulders and then grabbed her breast. When she pushed him away, she says he responded with an obscene gesture and asked her if she liked it.

Now she is suing him, the city and the city employees union for $5 million. The lawsuit says the city and union should be held liable for negligent hiring.

The lawsuit follows criminal charges against Cruz, who pleaded guilty to misdemeanor forcible touching and paid a fine. He has since retired.

The woman seeks judgment for each of eight different causes of action, including battery, assault, intentional infliction of emotional distress, negligent hiring and supervision, and creating a hostile work environment.
